Foreigners who have been declared “prohibited persons” (V listed persons), usually as a result of being found in possession of a fraudulent visa, will have to submit an application for the removal of the prohibition in terms of Section 29(2) of the Immigration Act.If and when a foreigner overstays his or her visa conditions, he or she will be declared an “undesirable person” and will have to submit an application for the upliftment of the undesirability in terms of Section 30(2) of the Immigration Act.
